The Rise in Back to Work Lawsuits

Presented by McGrannLAW and SwiftCheck

Say goodbye to FCRA class action lawsuits and hello to Back to Work class action lawsuits. COVID-19 employer related lawsuits are on the rise and employers are beginning to face a new legal challenge in uncharted waters. Beyond the massive impact that COVID-19 has had on the workplace, it is becoming critical that human resource departments understand the latest pitfalls related to Back to Work lawsuits and how to avoid them.

During this presentation, Owen McGrann will present on the topic points that have been set forth on behalf of the SwiftCheck legal counsel.  Key points and learning objectives:

  • Reviewing the latest 2020 OHSA requirements and active Back to Work litigation proceedings.
  • Discuss employers’ rights’, what they look like today and what they could look like with congressional intervention.
  • Reviewing the rise in retaliation lawsuits and how to prevent them.
  • Examine relative pre-pandemic employer litigation to help navigate future cases.
  • Understanding the penalties for not providing proper employee leave.
  • Examples of how employers are protecting both their employees and themselves from Back to Work related lawsuits.
  • How to prepare your organization in the event of a “second wave”.

About Attorney Owen McGrann:

Founding and Managing Member of McGrannLAW and focuses his practice on helping small businesses achieve big goals, families prepare for the future, and professionals navigate changing landscapes.  Owen has partnered with small businesses, professionals, and individuals on a wide array of matters ranging from business formation and small business counseling to all levels of estate planning, complex commercial and business litigation, appellate litigation, corporate governance, trade secret and non-compete litigation, and representation of medical professionals.

After practicing at two mid-sized regional firms and one of the country’s largest firms, Owen decided that he could best help his clients and provide truly personal representation by opening his own firm.
